If foreign workers want to participate in Viet Nam’s Labor Market, they have to fully meet the conditions and strictly comply with the procedures prescribed by Vietnamese labor law. Foreign workers who carry foreign nationalities are required to obtain work permits to register temporary residence cards and sign the labor contracts with their employers if they wish to live in Viet Nam.
Legal basis:
- Labor Law 2019 takes effect from the first of January, 2021;
- Decree 152/2020/ND-CP takes effect from the fifteenth of February, 2021;
Conditions to apply for a work permit for foreign workers working in Vietnam
For employer (Enterprise)
a) Enterprises, agencies, organizations, individuals, and contractors may only recruit foreign workers to perform their work as managers, executives, experts, and technical workers in case domestic workers are not able to meet the needs.
b) Foreign business enterprises, agencies, organizations, individuals, and contractors all have to register the need to recruit foreign workers and get an approval written by the competent state agency.
Application for the approval of foreign worker demands includes:
- Form No. 01/PLI Appendix I to Decree 152/2020 ND-CP
- Copy of Enterprise Registration Certificate
- Power of attorney + Personal documents of the authorized person (in case of an authorization submits the application)
For Foreign workers
- Have full civil capacity;
- Have professional qualifications, skills, and good health which meet the job requirements;
- Not committed to criminal or being examined for penal liability in accordance with Vietnamese and foreign laws;
Regulations and Responsibilities between the enterprises and employees
Regulations for employees
♦ Foreign workers are required to present a work permit when carrying out relevant procedures to the request of a competent state agency.
♦ Foreign workers who come to work in Vietnam without a work permit will be expelled from the Vietnamese and exported to the country according to the Government’s regulations.
Responsibilities of the employer (Enterprise)
Employers (Enterprises) who are hiring foreign workers to perform their work at the company without presenting their work permits will be administratively sanctioned under Labor Code.
Requirements and procedures to apply for a work permit for foreign workers in Vietnam
- A request form to apply for a work permit, made according to Form No. 11/PLI, Appendix I of Decree 152/2020 ND-CP;
- A medical certificate must be valid for less than 12 months from the date of application submission;
- A criminal record is issued within 6 months;
- Professional qualifications like diplomas, certificates, and work confirmation letters written by agencies, organizations, and enterprises in foreign countries show the number of years of working experience to meet the needs of job titles like managers, executives, experts, and technical workers. Besides, for some special professions like pilots, soccer players, and crew members…, procedures to apply for work permits will require other documents as prescribed by Labor Code.
- 2 color photos sized 4cm x 6cm (white background, straight face, bare head, wearing no colored glasses), taken within 06 months from the date of submitting the application.
- A copy of the Approval Letter of the need to employ foreign workers (issued in Section I – Application for approval to employ foreign workers)
- A copy of the original passport with a validity of more than 6 months;
- A copy of Enterprise Registration Certificate (Employment company) with a validity of more than 6 months.
*Note: The documents issued abroad need to be translated into Vietnamese, notarized, and consular legalized before submission.
