HOW MUCH DOES IT COST TO GET A VIET NAM WORK PERMIT

Legal basis

• Labor Code 2019, effective from January 1, 2021.
• Decree 152/2020/ND-CP dated December 30, 2020, takes effect from February 15, 2021.
• Circular 85/2019/TT-BTC dated November 29, 2019, of the Ministry of Finance, effective from January 13, 2021.
• Decision 526/QD-LDTBXH dated June 5, 2021, of the Ministry of Labor, War Invalids, and Social Affairs, effective immediately.

Who pays for the cost of a Work Permit

Service fee to obtain a work permit is collected by the competent state agency which is for issuing a work permit for a foreign worker legally working in an enterprise, agency, and organization operating in Vietnam. (Based on the provisions at Point d, Clause 2, Article 5 of Circular 85/2019/TT-BTC).

Besides, in Article 11 of Decree 152/2020/ND-CP and Decision 526/QD-LDTBXH, the employers are responsible for carrying out procedures to issue work permits to their employees.

According to Vietnamese laws, the employer is the one who has to bear the cost of obtaining a work permit for a foreign worker at the company.

The newest service fee to apply for work permits for foreign workers

According to the latest guidance in Decision No. 526/QD-LDTBXH dated May 6, 2021 (effective immediately), if a work permit is issued by the Ministry of Labor, War Invalids and Social Affairs, there will be no charges for the employers. However, if a work permit is issued by the Department of Labor, War Invalids, and Social Affairs, the employer has to pay a service fee for it.

Article 3 of Circular No. 85/2019/TT-BTC also states that the service fee for issuing work permits to foreign workers working in Vietnam will be decided by the People’s Council of the province.

Thus service fee for obtaining a work permit is different in each province.

Here is service fees for the issuance of Work Permits in different provinces, excluding other costs to complete the application. In order to complete the application and receive the result of a work permit, some other documents like criminal record, health certificate, consular legalized documents issued overseas, etc should submitted also. Therefore, the cost to apply for a work permit for foreigners will be much higher than the above service fee.
