How to get an investment visa (ĐT Visa) in Vietnam?

An investment visa or called DT Visa issued only to foreigners investing capital in the contribution of the companies or organizations. They can be owners, members/shareholders of the company). Investment visa types are granted depending on the financial ratio of the investors. However, the procedures to apply for an investment visa for foreigners to reside in Vietnam are still cumbersome if they do not have a full understanding of what they should do to process this visa. Legal basis

  • Law on Enterprise No. 59/2020/QH14
  • Consolidated document No. 27/VBHN-VPQH on entry, exit, and transit of oversea residences in Vietnam (including Law No. 47/2014/QH13 and Law No. 51/2019/QH14)
  • Circular No. 31/2015/TT-BCA, dated July 6, 2015, of the Ministry of Public Security guiding a number of contents on visa issuance, temporary residence card issuance, entry and exit permit, settlement of permanent residence for foreigners in Vietnam.
  • Circular No. 04/2015/TT-BCA dated January 5, 2015, of the Ministry of Public Security, stipulates the form of documents related to the entry, exit, and residence of foreigners in Vietnam.
  • Decision No. 5551/QD-BCA-V19 dated September 25, 2015, declares a set of administrative procedures under the handling competence of the Ministry of Public Security.

Symbols and subjects of investment visas for foreign investors:

According to the provisions of Article 8, Article 9 of Consolidation Document No. 27/VBHN-VPQH, investment visas for foreign investors have the following symbols with a range of different staying duration:

  • ĐT1 visa –  the validity of this visa is 5 years. It is issued to foreign investors in Vietnam and representatives of foreign organizations investing in Vietnam with a capital contribution of at least VND100 billion or investing in the business fields and areas of investment incentives decided by the Vietnam Government. 
  • ĐT2 visa – the validity of this visa is 5 years. It is issued to foreign investors in Vietnam and representatives of foreign organizations investing in Vietnam with a capital contribution of VND50 and under VND100 billion or investing in the business fields of investment encouragement decided by the Vietnam Government.
  • ĐT3 visa – the validity of this visa is 3 years. It is issued to foreign investors in Vietnam and representatives of foreign organizations investing in Vietnam with a capital contribution of VND3 and under VND50 billion. 
  • ĐT4 visa –  the validity of this visa is 12 months. It is issued to foreign investors in Vietnam and representatives of foreign organizations investing in Vietnam with a capital contribution of less than VND3 billion. 

Procedures for applying for an investment visa for foreign investors

An investor visa is an official document issued to foreign investors by a competent authority of Vietnam. It allows foreigners to enter and reside in Vietnam for a period of time following the validity of this kind of visa.

To obtain an investor visa (DT visa), you need:

  • Form NA5 – Visa application form, according to Circular No. 04/2015/TT-BCA, declared by foreigners.
  • A legal document introducing the signature and seal sample of the sponsor (Form NA16 issued together with Circular No. 04/2015/TT-BCA – Signed and stamped by the representative of the enterprise).
  • A request for a temporary residence card (Form NA6 issued together with Circular No. 04/2015/TT-BCA – Signed and stamped by the representative of the enterprise);
  • A certified copy showing the amount of capital contributed by the investor, such as a certificate of business registration if it’s a company limited, certificate of contributed capital if it’s a joint-stock company.
  • 02 photos sized 2×3 cm.
  • Original passport.
  • Documents proving that the foreigner has declared temporary residence.

 A sponsored company is asked to submit the application to the Immigration Department of the province or city or The Ministry of Public Security to apply for an investment visa.

Processing time: within 5 working days.

Note: If a foreigner holds one of these visa symbols DT1/DT2/DT3/DT4, a sponsored company can attempt to get a temporary residence card of the investment visa procedure instead.
