Legal basis:
– The Labor Code 2019 takes effect from January 1, 2021.
– Decree 152/2020/ND-CP dated December 30, 2020, takes effect from February 15, 2021.
1.Procedures to change the information in work permits for foreign workers
Some information that is shown in the Work Permit includes:
(1) Full name
(2) Nationality
(3) Passport number
(4) Working place
(5) Job position
(6) Job title
(7) Employment form
If one of the personal information above changes, the information of a work permit needs to be adjusted probably case-by-case which is still valid and suits the lastest regulations in Labor Code. Note: Adjusting the information in work permits must be based on the types of work permits that are re-issued or newly issued.
- Cases that will have to carry out re-issuance procedures: (1), (2), (3), (4) (based on the provisions of Clause 3, Article 12 of Decree 152/2020/ND-CP)
- The remaining cases shall carry out procedures for new issuance according to special cases: (5), (6), (7) (based on the provisions of point b, clause 9 of Article 9 of Decree 152/2020/ND-CP)
2.What is the application to change information in a work permit?
2.1. Application for work permits re-issuance:
According to the provisions of Article 13 of Decree 152/2020/ND-CP, an application for re-issuance of a work permit includes:
(1) The employer’s written request for the re-issuance of a work permit, which is made according to Form No. 11/PLI, Appendix I issued together with Decree 152/2020/ND-CP;
(2) 02 color photos sized 4×6 cm, white background, straight face, bare head, not wearing colored glasses), photos taken within 06 months from the date of application;
(3) A copy of the issued work permit which is still valid;
(4) Documents prove changes in work permits, case-by-case:
- Re-issue a work permit due to changes of passport: 01 notarized copy of new passport is required.
- Re-issue work permit due to change of company address: 01 copy of Enterprise Registration Certificate with new company address is required.
- Re-issue a work permit due to changes in personal information like passport holder’s name, or nationality: A copy passport or a valid document can replace a valid passport as prescribed by law.
(5) An approval letter of the need to employ foreign workers to perform work at the enterprise, except the case does not need it.
Notes on documents that must be consular legalized:
Documents specified in sections (3), (4), and (5) must be original or certified copies. If they are provided abroad, they must be consular legalized and translated into Vietnamese, except the ones which are legally exempted according to international treaties to which the Socialist Republic of Vietnam and related foreign countries are members, or on the principle of reciprocity or as prescribed by law.
Processing time: Within 03 working days from the date of completing the application for re-issuing a work permit, the Ministry of Labor – Invalids and Social Affairs or the Department of Labor – Invalids and Social Affairs shall re-issue the work permit. If a work permit is not re-issued, clear written documents state the reasons are submitted.
2.2. Application to issue new work permits in special cases:
In some special cases, the employees and employers have to prepare some additional documents, except specification (4):
- Documents prove employees are managers, director executives, experts, and technical workers;
- Certified copy of valid passport as prescribed by law;
